A CMP is a platform that allows users to manage their consent across digital touchpoints, promoting transparency and compliance with data protection regulations like the DPDP Act.
Benefits include ensuring regulatory compliance, improving operational efficiency, enhancing transparency, building user trust, mitigating risks, enabling scalability, and prioritizing a user centric approach.
Consent cannot be created or modified by one party alone without the other's approval, ensuring data integrity without causing user friction.
User data is encrypted and kept inaccessible to the platform provider. Secure communication between data fiduciaries and the Consent Manager occurs within the client’s environment.
Businesses can collect consent at a detailed level, allowing users to control specific data points, such as name, email, phone number, and preferences for sharing data with third party vendors.
Consent must be obtained when processing personal data, including collecting data, sharing with third parties, using data for new purposes, or retaining data beyond the original purpose, except where exemptions apply.
The DPDP Act, 2023, has been enacted but is not fully in force yet. Provisions are expected to be notified in phases along with the operationalization of the Data Protection Board (DPB). Organizations should prepare proactively.
Non compliance can lead to penalties of up to ₹250 crores per instance under the DPDP Act.
The requirement is currently uncertain under the DPDP Act. If cookies are interpreted as personal data, best practices include displaying cookie notices, obtaining explicit consent, providing opt-out options, and integrating a Consent Manager for compliance.
